1. Agreement to These Terms

By accessing or using topservicesph.com ("the Platform"), you agree to be bound by these Terms and Conditions and by our Privacy Policy. If you do not agree with any part of these terms, please do not use the Platform.

2. The Platform

TopServicesPH is an online marketplace that connects employers and clients with freelancers based in the Philippines. The Platform provides profiles, service listings, job postings, inquiries and direct messaging.

TopServicesPH is a venue for connection only. It is not an employer, a recruitment agency or an agent for any user, and it does not itself provide, perform or deliver the services listed on the Platform.

3. Accounts

You must register with a valid email address and verify it before using most features of the Platform. You are responsible for keeping your credentials confidential and for all activity under your account.

Only freelancers based in the Philippines may publish services, and clients must provide accurate information about themselves and their needs. You agree that the information you provide is truthful and current.

4. Services

Freelancers are solely responsible for the services they publish, including the accuracy of descriptions, skills, rates, availability and the quality and delivery of the work itself. Clients are responsible for the accuracy of the information they provide when inquiring, hiring or posting jobs.

TopServicesPH does not guarantee the quality, legality, timing or delivery of any service, and it does not verify the work product of any user beyond the verification steps described on the Platform.

5. Jobs and Applications

Any verified user may post a job listing describing work they want done. Only verified Filipino freelancers may apply, with a maximum of one application per job. Employers decide, at their discretion, whether to accept or reject applications. Job listings and applications must be genuine and not misleading.

6. Payments and Fees

Payment terms are agreed directly between clients and freelancers. TopServicesPH does not process payments, hold funds or charge commission on any engagement. The Platform is not a party to payment agreements or disputes between users, which must be resolved between the parties themselves.

7. Prohibited Conduct

You agree not to:

• Misrepresent your identity, location, qualifications or experience.
• Post false, fraudulent, illegal or misleading content.
• Harass, threaten, discriminate against or defame other users.
• Publish spam, malware or malicious content.
• Use the Platform for any unlawful purpose or to solicit prohibited services.
• Attempt to interfere with the operation or security of the Platform.

8. Moderation and Suspension

TopServicesPH may review, edit or remove content that violates these terms, and may suspend or close accounts for breaches of these terms, at its sole discretion. Where practicable, we will notify users of significant actions taken against their account or content.

9. Intellectual Property

Users retain ownership of the content they post. By posting content, you grant TopServicesPH a limited, non-exclusive license to host, display and distribute that content to operate the Platform. The Platform's design, branding, code and underlying technology are owned by TopServicesPH.

10. Disclaimer and Limitation of Liability

The Platform is provided "as is" and "as available". TopServicesPH disclaims all warranties, express or implied, including fitness for a particular purpose and non-infringement. To the maximum extent permitted by law, TopServicesPH shall not be liable for any indirect, incidental or consequential damages, or for the acts, omissions or conduct of any user. Users engage each other at their own risk.

11. Governing Law

These Terms and Conditions are governed by the laws of the Republic of the Philippines. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of the Republic of the Philippines.
